SpeakLink Terms of Service
Welcome to SpeakLink, a service provided by Think Link, a company located in Natick, Massachusetts, USA (referred to as “Think Link,” “we,” “us,” or “our”). By accessing or using the SpeakLink website, application, or any related services (collectively, the “Service”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
1. Acceptance of Terms
By using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization and represent that you have the authority to do so. These Terms form a binding agreement between you and Think Link.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use SpeakLink. By using the Service, you represent and warrant that you meet this requirement. You are not permitted to use SpeakLink if it is illegal to do so in your country or under any applicable law.
3. Changes to Terms
Think Link reserves the right to modify or update these Terms at any time. If we make changes, we will post the updated Terms on our website and/or notify you through other appropriate channels. Changes are effective immediately upon posting. Your continued use of the Service after updated Terms are posted constitutes acceptance of the changes. It is your responsibility to review these Terms periodically.
4. User Responsibilities
4.1 Account Information
To access SpeakLink, you may need to create an account. You agree to provide accurate, current, and complete information during registration (such as your name and email) and to keep this information up-to-date. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us immediately.
4.2 Prohibited Activities
When using SpeakLink, you agree not to engage in any of the following prohibited activities:
Illegal Use: Violate any applicable laws or regulations in connection with your use of the Service. This includes (but is not limited to) placing calls or transmitting content that is unlawful, threatening, or defamatory.
Fraud and Deception: Engage in fraudulent, deceptive, or harmful activities (e.g. scam calls). Do not use the Service to defraud, mislead, or otherwise harm others.
Impersonation: Misrepresent your identity or affiliation, or impersonate any person or entity without proper authorization. The Service must not be used for impersonation or pretending to be someone you are not.
Spam and Unwanted Calls: Use the Service to distribute spam, unsolicited marketing or bulk communications, or make harassing or nuisance calls. You may not use SpeakLink for spam or any form of unsolicited outreach that violates anti-spam laws.
Interference and Malicious Activity: Interfere with or disrupt the integrity, security, or performance of the Service. This includes attempting to interfere with other users’ use, launching any malware, viruses, or harmful code, or attempting to gain unauthorized access to the Service or related systems.
Think Link reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these Prohibited Activities, including suspending or terminating accounts as described in Section 12.
4.3 Call Recording and Consent
SpeakLink is a real-time phone call interpretation service. By using SpeakLink, you consent to our system processing, recording, and transcribing your call audio for the purpose of providing the translation service. If you use SpeakLink to facilitate calls with third parties, you are responsible for informing all participants that an AI service is being used and that the call may be transcribed. You must comply with all applicable laws regarding call recording and privacy. If the law in your jurisdiction requires that other parties consent to being recorded or monitored, you agree not to use SpeakLink for such calls unless you have obtained all necessary consents. You are solely responsible for the content of your communications through the Service and for ensuring that your use of call transcription and translation is lawful.
5. Intellectual Property and User Content
All intellectual property rights in the SpeakLink Service (including but not limited to software, algorithms, text, images, and trademarks) are owned by Think Link or our licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business use, in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our software or content, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
User Content: In the course of using SpeakLink, you may provide or generate content such as audio from phone calls, transcriptions, or other data (“User Content”). You retain all rights to your User Content. We do not claim ownership of the content of your calls or conversations. However, by using the Service, you grant Think Link a limited license to process and use your User Content solely for the purpose of providing the Service to you (for example, to transcribe and translate your calls and to display the transcripts to you) and for improving or troubleshooting the Service. This license is worldwide, royalty-free, and sublicensable only to our service providers as needed to operate the Service (such as our telephony and AI partners), and it terminates when you delete the User Content from our systems. We will handle personal information in User Content in accordance with our Privacy Policy (see Section 6).
You represent and warrant that you have all necessary rights in and to any content you transmit via SpeakLink, and that such content does not infringe or violate the intellectual property or privacy rights of any third party. We are not responsible for the content of your calls or any data you provide, and we do not monitor conversations in real-time. However, if we become aware that any User Content violates these Terms or law, we may remove, delete, or block access to such content and/or report it to law enforcement as appropriate.
6. Privacy
Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with the Service are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SpeakLink, you consent to the data practices described in the Privacy Policy. We encourage you to read the Privacy Policy carefully to understand how we handle your information.
7. Third-Party Services
SpeakLink relies on third-party services and integrations to function. For example, we utilize Twilio for telecommunication (connecting phone calls), OpenAI for AI-powered language processing, and Stripe or other payment processors for billing. The Service may also contain links or integrations to other third-party websites or services.
Please note that these third-party services have their own terms and privacy policies, and your use of those services will be governed by their terms. Think Link is not responsible for the content, policies, or practices of any third-party services. However, by using SpeakLink, you acknowledge that your data may be shared with these providers as necessary to operate the Service (e.g., call data with Twilio, conversation data with OpenAI, payment information with Stripe), as detailed in our Privacy Policy. We do not control third-party providers, so any issues arising from their services should be addressed with them. That said, if you encounter a problem with any integrated service, we welcome you to contact us and we will do our best to assist or provide guidance.
8. Payments and Fees
8.1 Payment Obligations
By signing up for a paid plan or using any feature of the Service that incurs fees, you agree to pay the applicable charges. Some premium features – for example, obtaining a dedicated SpeakLink phone number for your use, additional interpretation minutes, advanced spam filtering on calls, or other enhanced services – may carry monthly or usage-based fees. By opting into such features, you authorize Think Link to charge the applicable fees to your account balance or the payment method linked to your account. All fees are stated in U.S. dollars unless otherwise specified, and you are responsible for any applicable taxes.
8.2 Non-Refundable Charges
All charges and fees are non-refundable, except where required by law. This means that if you purchase a monthly subscription or other package and do not fully use the Service or choose to cancel before the end of the billing period, you will not be entitled to a full or partial refund for the unused time or services. We reserve the right, in our sole discretion, to make any exceptions (for instance, issuing pro-rated refunds or credits) on a case-by-case basis, but such exceptions are one-time and do not create a right to future refunds.
8.3 Payment Method
You must provide a valid payment method (such as a credit card or other approved payment account) and ensure that your billing information is accurate and up-to-date at all times. If automatic billing is enabled, you authorize Think Link (or our designated payment processor) to charge your provided payment method for recurring fees (e.g., monthly subscription fees) on each billing cycle. If we cannot process payment using your designated method (for example, due to expiration or insufficient funds), we may suspend or downgrade your access to paid features until payment is successfully processed. You are responsible for any charges or fees imposed by your payment provider (such as currency exchange fees or bank fees).
8.4 Phone Number Provisioning
As part of the SpeakLink Service, users may have the option to obtain a dedicated virtual phone number (e.g., a phone number that others can call which routes to the SpeakLink AI assistant or to you with translation services). If you choose to obtain a phone number through our Service, you must complete any required registration and maintain an active paid subscription for that number. Ownership of any phone number provided to you remains with Think Link or our telephony provider – not you. We grant you a revocable right to exclusively use the number as long as your account is in good standing and you continue to pay any associated fees. If you fail to make required payments or if your subscription lapses, we may suspend or terminate your access to the number and reclaim or reassign it to another user or revert it to the provider. Your rights to use any assigned phone number are contingent on compliance with these Terms and ongoing payment obligations. Please note that phone numbers are subject to availability and any specific use restrictions by region. You are responsible for using any provided number in compliance with the law (for example, you may not use it to make unlawful telemarketing calls or send unsolicited SMS in violation of regulations).
9. Disclaimers
Use at Your Own Risk: The SpeakLink Service is provided on an “as is” and “as available” basis. Think Link disclaims all warranties and representations, express or implied, regarding the Service, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific needs.
In particular, SpeakLink relies on artificial intelligence to interpret and translate calls in real time. We make no warranty or guarantee that the AI-generated translations or transcriptions will be accurate, reliable, or complete. There may be mistakes, delays, omissions, or inaccuracies in translations or speech recognition. You acknowledge these limitations and agree that Think Link is not liable for any errors in translation or transcription or any decisions you make based on them.
No advice or information, whether oral or written, obtained from Think Link or through the Service, will create any warranty not expressly stated herein.
10. Limitation of Liability
To the maximum extent permitted by law, in no event shall Think Link (or its officers, directors, employees, agents, or affiliates) be liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of (or inability to use) SpeakLink. This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
In no case shall Think Link’s total aggregate liability for all claims arising from or related to the Service exceed the amount you paid to us (if any) in the six (6) months immediately preceding the event giving rise to the claim, or fifty U.S. dollars (USD $50), whichever is greater. Some jurisdictions do not allow the exclusion or limitation of certain damages; to the extent such laws apply, some of the above exclusions or limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Think Link and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) that arise out of or relate to your use of the Service, your violation of these Terms, or your infringement of any rights of another. We reserve the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense of such claim. You agree not to settle any such matter without the prior written consent of Think Link.
12. Termination
Think Link may suspend or terminate your account or access to the Service at any time, with or without notice, if we believe (in our sole discretion) that you have violated these Terms, violated applicable law, or engaged in behavior that we determine is harmful to the Service or other users. We may also suspend or terminate the Service or any part of it, or your account, for any other reason at our discretion (for example, if we cease to offer the Service, experience a security incident, or for prolonged inactivity of a free account).
If your account is terminated, your right to use the Service will immediately cease. In the event of termination, Sections 5 (Intellectual Property and User Content), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and other provisions which by their nature should survive, will survive termination. If we terminate your account due to a violation of these Terms or law, no refund will be provided for any fees you have paid.
You may also cancel your account at any time if you no longer wish to use SpeakLink. Please refer to our website or contact our support for instructions on account deletion. Our Privacy Policy describes how we handle information upon account deletion.
13. Governing Law and Dispute Resolution
These Terms and your use of SpeakLink are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict of law principles. If you are an international user, note that you are voluntarily accessing the Service from the United States and agree that the laws of Massachusetts, USA apply to all matters relating to the Service and these Terms.
Dispute Resolution: In the event of any dispute, claim, or controversy between you and Think Link arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute informally. If we cannot resolve the dispute informally, before taking any formal legal action, we agree to attempt mediation. The mediation will be conducted by a neutral third-party mediator mutually agreeable to both you and Think Link, and will take place in Massachusetts (or via remote means). Each party will bear its own costs of mediation, and we will share the mediator’s fees equally.
If mediation fails to resolve the dispute, then either party may pursue legal action. You agree that any litigation arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the Commonwealth of Massachusetts, USA. You and Think Link both consent to the exercise of personal jurisdiction by and venue in such courts.
No Class Actions: You agree to resolve disputes with Think Link only on an individual basis, and not as a plaintiff or class member in any purported class or representative proceeding.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. The failure of Think Link to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
15. Entire Agreement
These Terms, together with our Privacy Policy (and any additional terms you agree to when using specific features or services), constitute the entire agreement between you and Think Link regarding your use of SpeakLink. They supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service. In case of a conflict between these Terms and any other policies or terms on the website, these Terms shall control.
No waiver by Think Link of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or any other term, and any failure to assert a right under these Terms shall not constitute a waiver of such right.
